When referring to 'sites' 'website' 'websites' we are referring to villagefetes.co.uk, countyfetes.co.uk, summerfetes.co.uk, flexyourplastic.co.uk, cateringads.co.uk and wholesalerads.co.uk
When referring to 'Villagefetes' we are referring to the business that owns all the listed named websites above.

Product feed listing terms and conditions

These terms and conditions are in addition and supplementary to our main directory advertising terms and conditions and therefore form part of Villagefetes general overall advertising terms and conditions. Villagefetes.co.uk Product Search and Price Comparison listing is strictly only available for wholesale and trade suppliers who specialise in providing products for the events, leisure, catering, retailer, event hire, hospitality and entertainment industries. Exceptions to this condition may occur at the discretion of Villagefetes where we feel the products offered will be of benefit to our targeted business audience, are rarely available wholesale and will not conflict with existing advertisers product ranges.

The advertisers/customers obligations

All product feeds are accepted by Villagefetes on the express condition that the Advertiser guarantees his product feed listing advertisement does not contravene the Trades Descriptions Act, 1968, the Sex Discrimination Act, 1976, or The Business Advertisements (Disclosure) Order, 1977. The Customer shall not place advertisements within their product feed with intent to transmit, communicate or knowingly display any material which is offensive, abusive, indecent, defamatory, obscene or menacing, or in breach of confidence, copyright, privacy, trade marks (whether registered or unregistered) or any other rights of any third party.

The advertiser/customer excepts

Product/data feeds will be uploaded to our server databases (with no exceptions) on the given date only, as set out in our guide. It is the responsibility of the advertiser to ensure the correct current product feed is available for that date. Product feed (where required) design, planning, setup, web space and hosting are the responsibility of the advertiser, Villagefetes will not offer telephone support for any of the previous technical areas other than provided in our guide. Product feeds with excessive broken image links will have all image links in that feed replaced with our standard "no image available" image. The advertiser/customer additionally excepts that their products and product feed will be displayed, listed, made searchable and included in price comparison results alongside other business advertisers products and product feeds, additionally product listings may include the option for user product reviews and product rating which are controlled, filtered and checked before inclusion by Villagefetes.

Our obligations

Villagefetes reserve the right to decline any product feed which we may not approve whether an order has been accepted or not. Villagefetes reserve the right to refuse to enter any product feed images, keywords or descriptions where we feel the wording directly or indirectly is infringing upon copyright, a registered trademark, racist, defamatory, sexually oriented or may cause offence to any company or individual. Every care is taken to ensure prompt insertion of all product feeds but guarantee of insertion cannot be given. Subject to payment of the set up costs and advertising option fees, and the terms of this agreement. Villagefetes shall provide advertising and such additional services as are agreed between the parties. Villagefetes warrants that the service will be provided with reasonable care in a professional and timely manner.

Images provided in your product feed

All images and image source links provided by you for any adverts within your product feed must be your own images. If we are notified that we have listed products using images from non legitimate sources, such as copying images from other websites, by either you or the legal owner of the artwork we shall remove the product feed immediately until the image links are replaced. Villagefetes will charge an additional set up fee for re listing or any feed corrections at our normal hourly rate and where any legal action has involved Villagefetes legal department the full cost will be passed on to the offending company or individual.

Product feed charges

All product feed option charges must be paid in full before product feeds are made live in our Product Search. Any offers, discounts or reductions agreed will only be available for 28 days from the date of the invoice. All product search listings will run in conjunction with your directory advertising invoicing.

Product feed listing rates

Product feed listing rates are subject to revision and the right is reserved to vary contract terms and conditions. Published product feed listing prices are excluding added VAT. All Product feed listing on all Villagefetes sites will be charged for inclusive of standard rate VAT.

Cancellation and refunds

Advertisers may cancel their product feed listing at any point throughout the advertising contract period however Villagefetes will not refund any monies for set up cost or for any remaining advertising contract period. Product feeds will be deregistered from our server databases on the next scheduled update date (with no exceptions). Refund will not be made under any circumstances arising from where the advertiser fails to provide an accessible current up to date product feed on the update date as set out in our guide. 

Confidentiality

Each party will at all times keep confidential and will not disclose without the prior written consent of the other any business or other confidential information of the other party or use any such information other than for the purposes contemplated by this Agreement (except that each party may disclose such information to those of its employees, agents and sub-contractors who need to know the same for such purpose and under conditions of confidentiality non-disclosure and non-use equivalent to those imposed on the parties by this Clause). These obligations of confidentiality, non-disclosure and non-use do not apply to any information which is publicly available through no fault of the party disclosing or using the information, or which was known to that party before receipt from the other party, or received from another source without obligation as to confidentiality, or which is required to be disclosed by law or by a regulating authority.

Disclaimer

Villagefetes will not be liable for any mistake or loss caused by error due to inaccuracies in the publishing of any product or data feed or for any circumstances arising there from. It is the responsibility of the advertiser to notify Villagefetes of any error immediately it appears. Villagefetes will not be liable for any loss incurred by any advertiser due to loss of database or server caused by server failure under any circumstances whatsoever, or resulting in temporary interruption to normal website operations. Villagefetes reserve the right to refuse any application for a product listing or any advertisement on such grounds as they think fit. Villagefetes reserves the right to republish any advertisement in electronic as well as printed format without seeking the advertiser's permission.
